In the United States there are a variety of mental health professionals. Evaluation is a series of interviews. You (or other qualifying people involved) will be asked to fill out forms, answer questions, or other assessment tasks. Written testimony is a statement containing the results of the evaluation. An expert witness can only testify about matters relevant to their field of expertise, following the procedures and strict ethical codes of their profession.
Even when the statement is provided in written form, the evaluator can eventually be asked to testify in court.
The testimony will only be valuable if the professional furnishes the proper credentials and details of professional training. Dr. Roth provides her credentials with each statement she writes.
Once finished writing the assessment findings, a statement will be forwarded to the qualified person (you, your attorney, the judge or a social worker). Dr. Roth is willing to provide her findings in court through oral testimony as well.
It depends on the case and who is soliciting it. Most of the time, you and your lawyer will receive a copy of the statement with the findings and Dr. Roth’s recommendations or opinion. Commonly, the statement is then forwarded by your attorney to the judiciary or other appropriate authority.
